MB Plastics Asia Thailand (“the Company”) respects your privacy rights and prioritizes the protection of personal data belonging to individuals who are associated with or conduct transactions with the Company. This Privacy Notice has been established to inform you, as a Data Subject, of the purposes and details regarding the collection, use, and/or disclosure of personal data, as well as your legal rights concerning your personal data.

This Privacy Notice covers various services provided by the Company through websites, applications, social media, and other channels for customers and visitors. By using the Company’s services or providing information to the Company, you acknowledge and accept the Company’s practices as described in this Privacy Policy.

Definitions

  • 1.1. “Personal Data” means any information relating to an individual that enables the identification of such person, whether directly or indirectly, excluding information of deceased persons.
  • 1.2. “Sensitive Personal Data means personal data that is inherently private but sensitive and may risk unfair discrimination, such as race, ethnicity, political opinions, cults, religious or philosophical beliefs, sexual behavior, criminal records, health data, disability, labor union information, genetic data, biometric data, or any other data which affects the Data Subject in a similar manner as prescribed by the Personal Data Protection Committee.

  • 1.4. “Data Subject” means an individual who is the owner of the personal data.
  • 1.5. “Data Controller” means a person or juristic person having the power and duties to make decisions regarding the collection, use, or disclosure of personal data.
  • 1.6. “Data Processor” means a person or juristic person who operates in relation to the collection, use, or disclosure of personal data pursuant to orders given by or on behalf of the Company.

2. Collection of Personal Data

2.1. Sources of Personal Data

The Company collects your personal data from the following sources:

  1. Directly from you: Such as information filled out to contact the Company, inquiries, feedback, complaints, or data from using products/services, visiting websites, Call Center, and other channels, including participation in activities, surveys, seminars, and roadshows.
  2. MB Plastics  Group Companies.
  3. Third parties: Including data service providers, business partners, social media platforms, and advertising service providers.
  4. Cookies and tracking technology: When you use the Company’s websites and applications. (Please refer to the Cookies Policy for more details).

2.2. Types of Personal Data Collected

  1. Personal details: Name-Surname, age, date of birth, gender, marital status, National ID number, passport number, postal address, workplace, phone number, email, Line ID, IP address, Cookie ID, browser information, and device information.
  2. Activity data: History of visits, searches, and interactions with the Company’s website or advertisements collected via cookies.
  3. Electronic data: Voice recordings, images, or other electronic data that may identify a person, including geographical location data.
  4. Sensitive Data: The Company will collect, use, and/or disclose sensitive data (e.g., race, religion, health, biometric data) only with your explicit consent or as required by law. For instance, voice identity may be collected to improve Call Center services.

3. Purposes of Collection and Use

  • 3.1. To provide services according to your needs: To deliver products and/or services as requested or per contract.
  • 3.2. To comply with legal obligations: To follow laws such as Tax, Anti-Money Laundering, and Computer Crimes laws. If you do not provide necessary data for legal or contractual purposes, the Company may be unable to provide products or services to you.
  • 3.3. For Legitimate Interests: Within reasonable expectations, such as:
    • Call Center voice recordings, CCTV footage, and visitor badge exchange.
    • Maintaining customer relationships, handling complaints, and satisfaction surveys.
    • Risk management, internal audits, and prevention of illegal acts (fraud, cyber threats).
    • Creating Anonymous Data.
    • Business purposes such as statistical analysis or public relations (photos/videos of meetings or events).
  • 3.4. For your benefit (Based on Consent): To provide better products/services, special offers, recommendations, and news.

4. Disclosure of Personal Data

  • 4.1. The Company will not disclose your personal data to any person without your consent and will only disclose it for the informed purposes.
  • 4.2. The Company may disclose data to affiliates or third parties (domestic and international) for operational purposes. These parties are required to maintain confidentiality and use data only within the scope defined by the Company.
  • 4.3. Disclosure may occur under legal requirements, such as to government agencies or regulatory authorities.

5. Retention Period

The Company will retain your personal data for as long as necessary to fulfill the purposes stated in this notice. This may extend if required by law (e.g., Anti-Money Laundering laws) or for the purpose of audits or legal disputes, not exceeding 10 years. Data will be deleted or anonymized once the period expires or it is no longer necessary.

  7. Right to Data Portability: To request your data in a commonly used electronic format to be sent to another Data Controller.
  8. Right to Complain: To file a omplaint with the Personal Data Protection Committee in case of violations of the Act.

8. Review and Changes to the Privacy Notice

The Company may update or amend this notice from time to time to align with service
